Terms of Service — My Smart Estimate

These Terms of Service (“Terms”) govern your use of the My Smart Estimate website and web application (the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1) Who We Are
My Smart Estimate (“My Smart Estimate”, “we”, “us”) provides a web-based estimating tool for contractors.
2) Privacy Policy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect information.
3) MVP / Beta Notice
The Service is currently an MVP/beta. This means features may change, be added, or be removed at any time; the Service may have bugs or downtime; and we may limit access (including Founders Club access) to improve performance and stability.
4) Eligibility
You must be at least 18 years old and able to form a legally binding contract to use the Service.
5) Accounts
You are responsible for keeping your login credentials secure, all activity under your account, and providing accurate information. We may suspend or terminate accounts for misuse or violations of these Terms.
6) Your Data & Content
You own the information you enter into the Service. By using the Service, you give us permission to host, store, and process your data only to provide and improve the Service, generate estimates/PDFs, and support your account. If you enter customer personal information, you confirm you have the right to collect and use that information. Data Backups: While we host and store your data to operate the Service, My Smart Estimate is not a dedicated data backup solution. You are responsible for maintaining your own independent records and backups. We are not liable for data loss resulting from user error, bugs, system downtime, or service interruptions.
7) Estimates Disclaimer (Very Important)
The Service generates estimates based on your inputs and your settings. You are responsible for reviewing and approving every estimate and PDF before sending it to a client. We do not guarantee: accuracy of pricing, final project costs, profitability or margins, code compliance, or suitability for any particular job.
8) Acceptable Use
You agree not to use the Service for unlawful purposes, attempt to access other users’ data, reverse engineer, scrape, or disrupt the Service, upload malware, or use the Service to send spam or unwanted messages.
9) Pricing, Billing, and Trials (MVP)
We may offer free trials, Founders Club access, and paid plans. Billing for paid plans is processed by Stripe. Plan details, limits, and prices may change during the MVP/beta period. Refunds and Cancellations: Payments are non-refundable except where required by law. If you cancel your subscription, we do not provide refunds or credits for partial billing periods. You will retain access until the end of your billing cycle. We may issue refunds for duplicate charges or billing errors.
10) Intellectual Property
The Service is owned by My Smart Estimate and protected by applicable laws. You may not copy, resell, or redistribute the Service without written permission.
11) Suspension and Termination
We may suspend or terminate access if you violate these Terms, misuse the Service, or for generic legal or operational reasons. You can stop using the Service at any time.
12) Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. To the maximum extent permitted by law, My Smart Estimate disclaims all warranties, whether express or implied. We do not guarantee that the Service will be completely secure, error-free, or operate without interruptions.
13) Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability is limited to the amount you paid us in the last 3 months, or $0 if you are on a free plan.
14) Indemnity
You agree to defend and indemnify My Smart Estimate from claims arising out of your use of the Service, your estimates, contracts, or your violation of these Terms.
15) Governing Law
These Terms are governed by the laws of Ontario, Canada. Any disputes must be resolved in the provincial or federal courts located in Ontario, Canada.
16) Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes means you accept the updated Terms.
